Agreement to Terms

These Terms constitute a legally binding agreement between you and Markaba App SARL SARLAU regarding your use of the Handita app, website (https://handita.com), and related services. By registering an account, you confirm you have the authority and meet the minimum age requirement to accept these Terms.

1. Account Security and Accurate Information

You must provide accurate information upon registration and keep it updated. You are responsible for safeguarding your authentication credentials. Handita is not liable for unauthorized access resulting from your failure to secure your device or OTPs.

2. Community Behavior and Prohibited Conduct

To maintain a safe ecosystem, you agree not to engage in:

  • Harassment, hate speech, threats, or impersonation.
  • Distribution of exploitation, child sexual abuse material (CSAM), or illegal content.
  • Scams, spamming, unauthorized data scraping, or manipulating our APIs.

3. User-Generated Content and Ownership

You retain ownership of the content you upload. By posting on Handita, you grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your content solely to provide and operate the Services.

4. Moderation, Reporting, and Appeals

We reserve the right to remove content, restrict accounts, or terminate access for Terms violations. Users can report violations in-app. Restricted users may utilize our formal appeals process; reviewed decisions are final.

5. Marketplace Rules

Handita acts as an intermediary for the Marketplace, connecting buyers and sellers. We are not the seller of the items listed by users.

  • Listings must be truthful and not include prohibited goods/services.
  • Buyers and sellers are individually responsible for honoring agreements, managing cancellations, and disputes.

6. Feedback and Submissions

Customers and employees may submit feedback. You must not upload unnecessary personal, confidential, or illegal information (including inside screenshots). Employee rewards relating to submissions are governed by internal programs and are strictly at company discretion.

7. Handita Plus & Payments

If Handita Plus (premium subscription) is available in your region, it operates via Apple StoreKit or Google Play Billing. Pricing is disclosed prior to purchase. Auto-renewal policies, cancellations, and refunds are managed strictly by the respective app store providers.

8. Intellectual Property & Complaints

Handita trademarks and code are owned by Markaba App SARL SARLAU. If you believe content infringes your copyright, submit a DMCA/IP complaint to support@handita.com.

9. Disclaimers and Limitation of Liability

Handita is provided "AS IS". Subject to applicable mandatory consumer law, Markaba App SARL SARLAU disclaims warranties of fitness for a particular purpose and shall not be liable for indirect, incidental, or consequential damages resulting from service interruptions or data loss.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of Morocco. Any disputes arising in connection with these Terms shall be resolved exclusively in the courts of Casablanca, Morocco.
